News agency ANI has moved a division bench of the Delhi high court against a single judge’s order dismissing its plea to restrain OpenAI from using its content to train ChatGPT .
On July 24, Justice Amit Bansal dismissed ANI’s plea, holding that OpenAI ’s use of the news agency’s material for training its large language model (LLM) fell within the statutory exception of “fair dealing” under Indian copyright law.
Court Ruling on AI Training Data Access
A recent 135-page verdict by Justice Bansal clarified that the training data for AI models was only accessible during the learning process and not available to the public for viewing or downloading. In response, ANI filed an appeal claiming that the court did not fully consider OpenAI’s alleged admission of scraping, storing, and commercially exploiting the agency’s work. ANI argues that these actions violate its exclusive rights under the Copyright Act, including rights to store, reproduce, adapt, and translate its original works.
